Handling Hurricane Harvey First Party Claims

A first party insurance claim is a claim between you, the policyholder, and the insurance company. These types of claims are contractual in nature as the specific terms and conditions control the claims handling of named perils covered by the policy. Not only do you have a contract with your insurance company, but your insurance company owes you certain duties under common law and Texas statutes, including the duty of utmost good faith and fair dealing. Your insurance company has a duty to thoroughly investigate your claim, to inform you of the specific policy provisions that apply to your claim, and they must have a satisfactory and reasonable basis and explanation for denial or underpayment of your claim.

Your insurance company is legally prohibited from:

  • Knowingly misrepresenting facts or provisions related to your coverage,
  • Failing to promptly acknowledge your claim or any information regarding your claim,
  • Failing to promptly investigate your claim,
  • Not attempting to achieve a prompt and fair settlement for your claim,
  • Offering less for your claim and thereby creating a situation in which you would feel compelled to sue the insurance company.
