What should patients know about medical device recalls?

On Behalf of | Nov 25, 2025 | Defective Medical Device Litigation |

Many people don’t think much about the testing and safety of medical devices when a doctor recommends they use one. While most medical devices are used successfully without any issues, there are times when defective ones make their way on the market.

There are times when medical devices are recalled, which can occur for a variety of reasons. These can be voluntary or mandated, depending on the circumstances surrounding the device.

Reasons for medical device recalls

There’s always a reason behind a medical device recall. Typically, these are because the medical device violates the United States Food and Drug Administration regulations or is a potential health hazard. The defects can involve the device itself, software or other specific items required for the device to be used properly. It’s also possible that missing safety warnings, incorrect instructions or improper packaging can also lead to recalls.

Medical device recall process

There are three specific parts of the medical device recall process. These include:

  • Classification of the recall into one of three numbered classes, with Class I being the most serious and Class III being the least serious
  • Notification about the recall to facilities and users of the medical device
  • Correction of the issue or removal of the device to address the issue that’s causing a safety concern

All medical device recalls are monitored by the FDA. This helps to ensure that they are handled as they should be so that more patients don’t face future harm.

For patients, learning that a medical device they’re using is defective is a frightening time. If something happened to that patient because of the defective medical device, they may opt to pursue a claim for compensation. These cases put them against large medical companies and aggressive legal teams, so those victims should ensure they have someone on their side who can help them throughout this process.
